If you do not agree to these Terms, you may not access or use our Services. We reserve the right to modify these Terms at any time. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.
Important: These Terms are governed by Indian law. Any disputes will be resolved through arbitration in accordance with the Arbitration and Conciliation Act, 1996. Please review Section 15 carefully.
2. Eligibility
You must be at least 18 years old to use our Services. By using the Services, you represent and warrant that:
- You are at least 18 years of age
- You have the legal capacity to enter into these Terms
- You will provide accurate and complete information when creating an account
- You will not use the Services for any illegal or unauthorized purpose
- Your use of the Services will comply with all applicable laws and regulations
3. Account Registration and Security
To access certain features of our Services, you must create an account. You agree to:

- Maintain and promptly update your account information
- Maintain the security of your password and account
- Notify us immediately of any unauthorized use of your account

Summit provides an online platform connecting users with mental health resources, including:
- Access to licensed mental health professionals for therapy sessions
- Educational resources and articles about mental health
- Community forums for peer support and discussion
- Tools and assessments for mental wellness

5. User Responsibilities and Conduct
When using our Services, you agree NOT to:
- Violate any applicable laws or regulations
- Infringe on the rights of others, including intellectual property rights
- Post harmful, abusive, harassing, or offensive content
- Share false, misleading, or deceptive information
- Impersonate another person or entity
- Attempt to gain unauthorized access to our systems
- Distribute viruses, malware, or other harmful code
- Use automated systems (bots, scrapers) without permission
- Share another user's personal information without consent
- Use the Services for commercial purposes without authorization
6. Therapy Services
Therapist-Client Relationship
When you book a session with a therapist through our platform:
- A professional therapeutic relationship is established between you and the therapist
- The therapist is an independent professional, not an employee of Summit
- All clinical decisions are made by the therapist, not Summit
- Therapist-client communications are confidential (subject to legal exceptions)
Appointments and Cancellations
You agree to:
- Attend scheduled appointments or cancel at least 24 hours in advance
- Pay applicable fees for missed appointments per the therapist's cancellation policy
- Be punctual for scheduled sessions
- Provide accurate health information to your therapist
Limitations of Online Therapy
You understand and acknowledge that:
- Online therapy may not be suitable for all mental health conditions
- Technology issues may occasionally interrupt sessions
- Your therapist may determine that in-person care is more appropriate
- Emergency services cannot be provided through the platform
7. Payment and Fees
Certain Services require payment. You agree to:
- Pay all fees associated with your use of the Services
- Provide current, complete, and accurate billing information
- Promptly update payment information if it changes
- Pay for services at the time of booking or as otherwise specified
We use third-party payment processors. All payment information is encrypted and securely handled in compliance with PCI DSS standards.
Refunds
Refund policies vary by service type. Generally:
- Therapy session fees are non-refundable once the session begins
- Unused subscription credits may be refundable within 30 days of purchase
- Refund requests must be submitted in writing to support@summit.com
8. Intellectual Property Rights
The Services and all content, features, and functionality are owned by Summit and are protected by copyright, trademark, and other intellectual property laws.
You may not:
- Copy, modify, or distribute our content without permission
- Use our trademarks or branding without authorization
- Reverse engineer or attempt to extract source code
- Create derivative works based on our Services
9. User-Generated Content
You may post content to our community forums and other areas of the platform. By posting content, you grant Summit a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with the Services.
You retain ownership of your content and are responsible for ensuring you have all necessary rights to post it. We reserve the right to remove any content that violates these Terms or is otherwise objectionable.
10. Privacy and Data Protection
Our services comply with the Indian Medical Council (Professional Conduct, Etiquette and Ethics) Regulations, 2002, Telemedicine Practice Guidelines 2020, and all applicable Indian healthcare regulations. All therapists on our platform are registered professionals licensed to practice in India.
11. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
We do not warrant that:
- The Services will be uninterrupted, secure, or error-free
- The results obtained from using the Services will be accurate or reliable
- Any errors will be corrected
- The Services will meet your specific requirements
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUMMIT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SERVICES.
Our total liability to you for any claims arising from your use of the Services shall not exceed the amount you paid to Summit in the 12 months preceding the claim.
13. Indemnification
You agree to indemnify and hold harmless Summit, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the Services
- Your violation of these Terms
- Your violation of any rights of another party
- Any content you post or share through the Services
14. Termination
We reserve the right to suspend or terminate your account and access to the Services at any time, with or without cause, and with or without notice.
You may terminate your account at any time by contacting us at support@summit.com. Upon termination:
- Your right to access the Services immediately ceases
- We may delete your account and content (subject to legal retention requirements)
- Provisions that should survive termination will remain in effect
15. Dispute Resolution and Arbitration
Please read this section carefully. It affects your legal rights.
Any dispute arising from these Terms or your use of the Services shall be resolved through binding arbitration rather than in court, except that you may assert claims in small claims court if they qualify.
Class Action Waiver
You agree that disputes will be resolved on an individual basis only, and you waive any right to participate in a class action lawsuit or class-wide arbitration.
